Only if they hold an employer-specific, LMIA-exempt work visa may they earn the points needed for the job offer without an LMIA. A post-graduation work permit (Post-Graduation Work Permit, for example) indicates that you must get an LMIA for them in order to earn the points.
The following are the steps businesses must take to recruit an Express Entry applicant with a legitimate job offer:
make sure that the individual is offered a full-time, LMIA-supported employment in writing that will continue for at least one year after they are granted permanent status if you require one.
Who does not require an LMIA?
An LMIA isn’t necessary if:
If you already did it when you originally hired foreign worker and you want to extend their job offer for at least one more year, you should have a valid work visa that was exempt from an LMIA under an international treaty like CUSMA. Or if the work permit falls under the International Mobility Program, such as a federal-provincial work permit, you must have a valid work permit that is at least one year old.
In other words, if your circumstance falls under one of the LMIA exemption codes or work permit exemption codes established by the Canadian government, you do not need an LMIA.
It is possible to contact the International Mobility Workers Unit for help if you are still confused and are recruiting a foreign worker from a visa-exempt country who is not already in Canada.
What to inform your employee
Your employee will need to update their Express Entry profile with the following:
Name and address of employer, start date, LMIA identification number, and NOC code.
As long as their application is being processed, most international employees may continue to work in Canada. A Bridging Open Work Permit may be obtained if a person’s temporary status is due to expire between the time they apply for permanent residency and the time they get a decision.
One can’t predict exactly how long it will take for an Express Entry application to be processed. The usual processing time for Express Entry applicants is six months or fewer, however in 2020 it took the average applicant nine months to get permanent resident status
