Unlimited Work Opportunities
An open work permit allows foreign nationals to work for any employer in Canada, unlike a closed work permit which allows foreign nationals to work for one employer or in one occupation only. A Labour Market Impact Assessment (LMIA) is not a need for employers who hire SOWP holders.
Eligibility for the SOWP
Applicants for inland sponsorships must already live together in Canada as spouses or common-law partners and have temporary status in Canada as workers, students, or visitors. Sponsorship candidates must meet the following requirements to be eligible for an open work permit:
- Make sure to apply under the Spouse Common-Law Partner class for permanent residence.
- Must be sponsored by a spouse or common-law partner who is a Canadian citizen or permanent resident.
- Applicants must live at the same address as their sponsors because living apart will make the applicant not qualify.
- Possess a valid temporary resident status in Canada or successfully applied for restoration status with authority to work there.
- Those who wish to become permanent residents through spousal sponsorship and apply for an open work permit can do so simultaneously.
The SOWP application can be submitted online by applicants who have previously received approval for their permanent residency application. Even if the spouse or partner receives approval in principle letter from the IRCC, but still needs to pass the medical, security, and background checks. When the SOWP expires, a decision about immigration may not yet be made. SOWP holders must apply to extend their permits before they expire.
